Listing Terms and Conditions

By listing your apartment for rent through the Site's listing service, you acknowledge and agree that: (a) you own or have the right to advertise the apartment you list for rent; (b) you have the right to lease the advertised apartment; (c) you are willing to lease the advertised apartment at the price and on any other terms specified in your listing; (d) you will post only one listing per unique apartment unit and you will not advertise more than one apartment unit in a single listing, either by including descriptions of multiple apartments in one listing or by subsequently updating the listing information to advertise different apartments; (e) upon leasing or otherwise taking your apartment off the market, you will within 72 hours update the listing status to rented for that apartment; (f) you will not use your listing to advertise or promote anything (including, without limitation, any product, service or business) other than one unique apartment unit offered for rent; (g) except as provided in ApartmentScout.ca's current Refund Policy, you will pay ApartmentScout.ca for your commercial listings, even if you fail to lease your apartment(s) or are dissatisfied with ApartmentScout.ca; (h) you will not use your listing or the Site for any fraudulent, false, misleading or deceptive activity; (i) all Materials that you provide to ApartmentScout.ca are truthful, accurate and complete and complies with all local, Canadian and Provincial laws and regulations, including without limitation, housing laws; (j) you are solely responsible for any and all listings, and all content, photos, data or other Materials you submit to the Site; (k) you have the all rights necessary to post your listings, including, without limitation, all content, photos, data and other Materials contained therein, on the Site; and (l) photos provided for the listing will only show the apartment listed for rent and shall not include under any circumstances people, animals, trademarked items, religious symbols, or other objects or features not part of the apartment or apartment community.

ApartmentScout.ca reserves the right, in its sole discretion, to remove any listing or photo, without notice and without liability or providing a refund, that does not meet the requirements of these ListingTerms & Conditions, the Site's Terms of Service, ApartmentScout.ca's policies, or if ApartmentScout.ca otherwise determines or believes, in ApartmentScout.ca's sole and exclusive discretion, that your listing or any photo or other content you upload is inappropriate for any legal, business, technical or other reason.

Listing Accounts:

ApartmentScout offers two types of accounts for listings properties "COMMERCIAL USER" and "RESIDENTIAL USER".

A RESIDENTIAL USER is defined as a user that will list no more than the maximum number of listings as defined by the RESIDENTIAL LISTING OPTION. RESIDENTIAL USERS can purchase additional listings as per the ADDITIONAL LISTING FEE for RESIDENTIAL USERS.

A COMMERCIAL USER is a user that will list more than the maximum allowed listings of the RESIDENTIAL LISTING OPTION and/or rents real estate that includes income producing property such as multiple apartment units, apartment buildings, multiple condos, office space and/or buildings, restaurants, retail space, industrail space, warehouse space. COMMERCIAL USERS are required to purchase a listing package and follow the Site's Terms of Service, and Listing Terms and Conditions. The number of listings is limited to the listings package purchased.

Listing Details:

Currently, ApartmentScout.ca offers various listings packages. The Number of permitted listings varies by listing package. Each listing will run for a maximum period of four (4) calendar weeks.

Listing Renewals:

If you are a non commercial user of ApartmentScout you can renew your listing(s) as many times as required for an additional four (4) weeks once a listing(s) has expired. If you are a COMMERCIAL USER of ApartmentScout, listing renewals count towards the number of listings your purchased in your listing package. Listings will appear on the Site only until the stated end date, when it will be removed from the public search results with a status of expired, allowing you to renew the listing at a later date.

Photos:

ApartmentScout.ca listings packages include from 0- 10 photos of the actual advertised apartment or apartment community.

GENERAL LIMITATIONS

Listings only contain the features expressly indicated.

APARTMENTSCOUT.CA DOES NOT MAKE AND EXPRESSLY DISCLAIMS ANY AND ALL REPRESENTATIONS AND WARRANTIES TO YOU REGARDING THE LISTING SERVICE, INCLUDING, WITHOUT LIMITATION, ANY REPRESENTATIONS OR WARRANTIES THAT YOU WILL LEASE YOUR APARTMENT, OBTAIN AN ACCEPTABLE RENT FOR YOUR APARTMENT, ONLY RECEIVE LEGITIMATE INQUIRIES OR SOLICITATIONS FROM QUALIFIED RENTERS, OR RECEIVE ANY INQUIRIES REGARDING YOUR APARTMENT FOR RENT.

ApartmentScout.ca reserves the right to, but is under no obligation to and does not assume any obligation to, review listings before and/or after they are posted to the ApartmentScout.ca site to confirm information relating to the advertiser and the advertised apartment and to investigate complaints and suspicious activity. If ApartmentScout.ca determines, in its sole and exclusive discretion, that you are engaging in any unfair, deceptive, false, misleading or fraudulent practices, or that your listing violates any laws or guidelines, ApartmentScout.ca reserves the right to reject or immediately remove your listing from the ApartmentScout.ca site without notice and without liability or providing a refund, as described above.

Listing Package Refund Policy

As a general matter, ApartmentScout.ca does not provide refunds for listing packages after a package is purchased except if you mistakenly purchased a duplicate package for the same user account, and both appear on the Site at the time of your request. In order to be eligible to receive a refund under this circumstance, ApartmentScout.ca must receive your refund request in the manner described below within 5 calendar days of your purchase of the second listing package. ApartmentScout.ca further reserves the right to make refunds at any time in connection with cases of fraud, abuse, and in other limited instances. ApartmentScout.ca does not provide refunds under any other circumstances. Notwithstanding anything in this policy to the contrary, ApartmentScout.ca reserves the right to finally determine in its sole discretion whether the criteria for a refund set forth in this policy have been satisfied and to request any additional information relevant to such request. All refund requests must be in writing and include your name, address, e-mail address, user id, the last payment transaction id of the purchase the listing package, and the reasons you are requesting a refund. Please send all refund requests to support@apartmentscout.ca.

ApartmentScout.ca is not responsible for refund requests that are not timely received in accordance with this policy for any reason, including without limitation, Web congestion, addressing mistakes, computer or Internet downtime, or requests submitted by phone, postal mail, or any other manner not expressly provided for in this policy. NOTE: The Listing Package Refund Policy applies to online-only listing packages purchased on the Site.
